Die Beihilfe wird vom deutschen Gesetzgeber in § 27 Abs. 1 StGB als vorsätzliche Hilfeleistung zu einer tatbestandsmäßig-rechtswidrigen und vorsätzlichen Tat umschrieben. Um einen Einstieg in die Problematik der „neutralen Handlungen“ zu ermöglichen, soll folgender Fall dienen: Ein Naturfreund züchtet Blumen, obgleich er weiß, dass sein Nachbar, ein notorischer Heiratsschwindler, gerade diese Blumen stehlen und als Präsent zu einer Betrügerei ver-wenden wird. Bei schulmäßiger Subsumtion dieses Sachverhaltes gelangt man ohne größere Anstrengung zum Ergebnis der Beihilfestrafbarkeit, wenn die unterstützte Haupttat zumindest in das Versuchsstadium gelangt. Mit Blick auf den an sich alltäglichen Charakter dieser Handlung ist die Frage nach der strafrechtlichen Relevanz der zumindest mit neutralem Anschein versehenen Mitwirkungshand-lung notwendig. Vor dem Hintergrund des Funktionierens einer auf Arbeitsteilung angelegten Gesellschaft, in der ein neutrales Unterstützungsverhalten leicht zu erhalten ist, stellt sich die Frage, ob die uneingeschränkte Einbeziehung solcher „neutraler Handlungen“ in die Beihilfestrafbarkeit zu unangemessenen Ergebnis-sen führt. Ziel dieser Arbeit ist es, einen umfassenden Überblick über den Stand der Diskussion in der Rechtswissenschaft zum Thema „Beihilfe durch neutrale Handlungen“ zu geben. Hierfür wird zunächst die historische Entwicklung der Thematik dargestellt und sodann mögliche Erscheinungsformen „neutraler Hand-lungen“ vorgestellt. Im darauf folgenden Abschnitt wird auf den Strafgrund sowie auf den objektiven und subjektiven Tatbestand der Beihilfe näher eingegangen. Anschließend wird die Rechtsprechung anhand von ausgewählten Fällen darge-stellt und die existierenden Lösungsansätze in der Literatur nachgezeichnet und kritisch gewürdigt. Von der Bearbeitung des Themas „Beihilfe durch neutrale Handlungen“ soll die Problematik der Rechtsauskunft durch einen Anwalt als mögliche Beihilfe ausgeschlossen werden, da diese im Hinblick auf zahlreiche berufs- und verfassungsrechtliche Aspekte eine separate Bearbeitung erfordert.
