Und spätestens seit dem publikumswirksamen Auftritt des Altbundeskanzlers Gerhard Schröder bei der Rettungsaktion des damals größten deutschen Baukonzerns, Philipp Holzmann AG, Ende 1999 trat das Beihilfenregel-ment aus dem Schattendasein der Kommissionspraxis heraus und ge-wann an öffentlichem Interesse.
Dieses Manuskript soll einen Einblick in das weite Feld des Beihilfen-rechts ermöglichen und insbesondere die Eigenschaften der marktinkon-formen Beihilfen und deren Ausnahmetatbestände detailiert und mit Bei-spielen unterlegt beleuchten. Um der Vollständigkeit Genüge zu tun, wird auch auf das Verfahren der Beihilfenkontrolle eingegangen. Auf eine Dar-stellung der Methode der Beihilfenrückforderung wurde jedoch verzichtet, um den umfänglichen Rahmen dieser Arbeit nicht zu sprengen.
